RULES OF THE wearJUSI.com STORE APPLICABLE FROM APRIL 1, 2021

1. GENERAL PROVISIONS

1. The entrepreneur running the online store located in the internet domain www.wearjusi.com, hereinafter referred to as the "Online Store", is run by Justyna Stańdo, running a business under the name JUSI Justyna Stańdo, entered into the KRS run by the minister responsible for the economy, NIP 5273098199, with its registered office in Warsaw, ul. Mordechaja Anielewicza 47c/23, 01-060 Warsaw.
2. Contact with the Online Store is possible via e-mail: bok@wearjusi.com, by phone from Monday to Friday 8:00-18:00, at the telephone number: + 48 604 431 964.

2. DEFINITIONS

1. Regulations - these "Online Shop Regulations";
2. Working days - days from Monday to Friday, except for public holidays.
3. Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, to whom a separate act grants legal capacity, conducting business activity on its own behalf, which uses the Store
4. Privileged entrepreneur - a natural person concluding a contract directly related to its business activity, when the content of this contract shows that it does not have a professional nature for that person, resulting in particular from the subject of its business activity, made available on the basis of the provisions on the Central Register and Information on Economic Activity.
5. Consumer - a natural person concluding a contract with the Seller as part of the Store, the subject of which is not directly related to its business or professional activity.
6. Account - the Customer's account in the Store, enabling the Customer to make purchases in the Store, in which, among others, data provided by the Customer and information about Orders placed by him are collected; setting up an account is free
7. Customer - a natural person with full legal capacity, a legal person or an organizational unit without legal personality, to whom separate provisions grant legal capacity, making purchases in the Store on the terms set out in the Regulations

9. Registration Form - a form available in the Store that allows you to create an Account
10. Order Form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the Basket and specifying some terms of the Sales Agreement, in particular the method of delivery and payment.
11. Products - goods owned by JUSI with its registered office in Warsaw, offered for sale to Customers at www.wearjusi.com
12. Basket - an element of the Store in which the Products selected by the Customer are visible and in which the Customer has the option of determining and modifying the Order data, in particular the quantity of Products purchased
13. Order - Customer's declaration of intent submitted via the Order Form and aimed directly at concluding a Sales Agreement
14. Sales Agreement - a Product sales agreement concluded or concluded between the Customer and the Seller via the Store

3. TECHNICAL REQUIREMENTS

1. For the proper functioning of the Store, you need:
a) a device with Internet access
b) a web browser that supports JavaScript and cookies

2. To place an order in the Store, in addition to the requirements set out in paragraph 1, an active e-mail account is required.
3. Logging into the Account is done by entering the login and password set by the Customer in the Registration Form
4. To set up an Account in the Store, you must complete the Registration Form. It is necessary to provide the following data: - Customer's name and surname, Customer's email address, Account password
5. The customer may at any time request the removal of his Account
6. The Seller shall not be liable for disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties or incompatibility of the Store with the technical infrastructure of the Customer

4. SHOPPING IN STORE

1. The prices given in the Store are given in Polish zlotys and are gross prices (including VAT).
2. Log in to the Store (optional).
3. Select the Product being the subject of the Order, and then click the "Add to Cart" button.
4. Log in or use the submission optionOrders as a guest .
5. If the possibility of placing an Order as a guest has been selected - fill in the Order Form by entering the details of the recipient of the Order and the address to which the Product is to be delivered, select the type of shipment (method of delivering the Product), enter the invoice data, if different from the details of the recipient of the Order.
6. Click the "Proceed to checkout" button.
7. Choose one of the available payment methods and, depending on the payment method, pay for the order within the specified period
8. We confirm the placement of the Order by e-mail immediately after you send the Order. The conclusion of a binding Sales Agreement takes place when you receive confirmation of acceptance of the Order for execution.

5. PAYMENTS

1. Payment for the placed order can be made, depending on the Buyer's choice:

2. By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The buyer has the right to withdraw his acceptance
3. You bear all costs of financial transactions

6. ORDER EXECUTION

1. The Customer may use the following methods of delivery of the ordered Product:
a) courier delivery,
b) InPost parcel lockers.
2. The shipping costs are borne by the person placing the order for the Product
3. During the ordering procedure, you will receive information about the cost of shipping the ordered Products and their delivery to the address indicated by you.
4. In the case of Ordering several Products, they will be delivered in one shipment within the time corresponding to the longest of the waiting times indicated for the ordered Products, visible next to each of the Products in the Store.
5. If the Customer chooses the method of payment by bank transfer - from the date of crediting the Seller's bank account.
6. The Customer is obliged to make the payment by bank transfer within 2 calendar days from the date of conclusion of the Sales Agreement. In the absence of payment after 2 business days, the order will be cancelled.

7. RIGHT OF WITHDRAWAL

1. In the case of purchasing Products, the Customer who is a Consumer has the statutory right to withdraw from the Sales Agreement.
2. If you wish to exercise your right to withdraw from the Sales Agreement, please use the withdrawal form available in your Account. Please help us avoid additional costs and always send returned Products after completing the withdrawal form available through your Account
3. If you withdraw from the Sales Agreement, we are obliged to immediately, but not later than within 14 days from the date of receipt of your statement of withdrawal from the Sales Agreement, return to you all payments received from you, including delivery costs (except for additional costs that possibly arise in connection with your choice of a different delivery method than the cheapest usual delivery method offered by us). We use the same means of payment for the refund that you used for the original transaction, unless we explicitly agree a different means of payment with you. Under no circumstances will we charge you any fees for this. We may withhold reimbursement of any payment received from you until we receive the return of the Product or until you provide proof that the Product has been shipped to us, whichever is earlier. All refunds are made automatically to the bank account number used by you for payment. In the case of payment by bank transfer, payments will be returned to the account from which the transfer was made.
4. Immediately after receiving your statement of withdrawal from the Sales Agreement, regardless of whether it was made via the Customer Account or in the electronic form provided for in paragraph 3 above, we will confirm receipt of your statement by the Seller.
5. You are responsible for the decrease in the value of the Product as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of such an item. In order to determine the nature, characteristics and functioning of the item, you can normally open or unpack the package to check the characteristics and functioning of the item and examine it in a manner customary in stationary stores.
6. The seller refunds the payment using the same method of payment as used by the consumer, unless the consumer has expressly agreed to a different method of return, which does not involve any costs for him

8. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right to withdraw from a distance contract is not entitled to the Consumer in relation to the contract:
a)  in which the consumerthe subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to meet his individual needs. is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging was opened after delivery. by their nature, they are inseparably connected with other items.
f)   periodicals or magazines, with the exception of a subscription agreement.
h)  in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawing from the contract.
i)   the supply of digital content that is not recorded on a tangible medium.

9. COMPLAINTS

1. In the event of a defect in the goods, the Buyer has the option to complain about the defective goods on the basis of the warranty or guarantee regulated in the Civil Code, provided that the guarantee has been granted.
5. Using the warranty, the Buyer may, on the terms and within the time limits specified in the Civil Code:
a. submit a price reduction statement
b. in the case of a significant defect - submit a declaration of withdrawal from the contract
c. demand replacement of the item with a defect-free item
d. demand removal of the defect
6. The seller asks you to submit a complaint under the warranty to the postal address or via the store's website. A detailed description of the return procedure can be found on the seller's website in the "Return" tab
7. If it turns out that in order to consider the complaint, it is necessary to deliver the advertised goods to the Seller, the Buyer is obliged to deliver these goods, at the expense of the Consumer, to the address provided in the return form or to the address of JUSI Justyna Stańdo Sp. z o.o. ul. Tęczowa 14/5, 49-300 brzeg   tel. 500 672398 JUSI 

8. If an additional guarantee has been granted for the goods, information about it, as well as about its terms, is available in the product description in the Store.
9. Complaints regarding the operation of the Store should be sent to the e-mail address indicated in § 2 of the Regulations.
10. The complaint will be considered by the Seller within 14 days.

10. EXTRA-JUDICIAL METHODS OF HANDLING COMPLAINTS AND SEARCHING CLAIMS

1. Detailed information on the possibility for the Consumer to use out-of-court methods of dealing with complaints and pursuing claims as well as the rules of access to these procedures are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of the Inspection Handlowa and at the following Internet addresses of the Office of Competition and Consumer Protection: https://www.uokik.gov.pl/spory_konsumenckie.php; https://www.uokik.gov.pl/sprawy... and https://www.uokik.gov.pl/wazne_adresy.php.
2. The consumer has the following exemplary possibilities of using out-of-court methods of dealing with complaints and pursuing claims:
3. The consumer is entitled to apply to the permanent amicable consumer court referred to in art. 37 of the Act of December 15, 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to settle a dispute arising from the Agreement concluded with the Seller.
4. The consumer is entitled to apply to the provincial inspector of the Trade Inspection, in accordance with art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.
5. The consumer may obtain free assistance in resolving the dispute between him and the Seller, also using the free assistance of the poviat (municipal) consumer ombudsman or social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).

11. PERSONAL DATA

1. The administrator of personal data provided by the Buyer when using the Store is the Seller.
2. The Buyer's personal data is processed mainly on the basis of the contract and for its implementation, in accordance with the principles set out in the General Regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information on data processing by the Seller is contained in the privacy policy posted in the Store.

12. DISCLAIMER

1. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Regulations. The contract is concluded for the time and in order to fulfill the order.
2. Agreements concluded on the basis of these regulations are concluded in Polish.
3. None of the provisions of these regulations exclude or in any way limit the rights of the Consumer under the law.
4. Provisions regarding goods and the sales contract shall apply accordingly to digital content and the contract for the supply of digital content, unless the Regulations specify these issues separately.

13. PROVISIONS FOR NON-CONSUMER BUYERS

1. The right to withdraw from a distance contract is not entitled to an entity other than the Consumer.
2. Any liability of the Seller towards the Buyer who is not a Consumer is excluded.
3. In the event of any dispute with the Buyer who is not a Consumer, the competent court will be the court competent for the seat of the Seller.

14. FINAL PROVISIONS

1. Agreements concluded through the Online Store are concluded in Polish.
2. The Seller reserves the right to amend the Regulations for important reasons, that is: changes in the law, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. The Seller shall inform the Customer of any change at least 7 days in advance.
3. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the act on the provision of electronic services; the act on consumer rights, the act on the protection of personal data.
